Thropic Games Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the contests, champion pages, daily games, leaderboards and related pages operated by Thropic Games, Inc. ("Thropic", "we", "us") at thropicgames.com and its subdomains (together, the "Platform"). By signing up, playing, voting or giving on the Platform, you agree to these Terms, to the Official Rules of the contest you take part in, and to our Privacy Policy. If you do not agree, do not use the Platform.
NO PURCHASE, PAYMENT OR GIFT OF ANY KIND IS NECESSARY TO ENTER, TO VOTE, OR TO WIN. Every voter can vote for free every day by playing.
1. How a contest works
A Thropic contest is a competition amongst champions to win a real prize.
The Partner. Each contest is opened by an organization (the "Partner"), such as a team, school, nonprofit or charity platform, for a cause it supports (the "Cause"). One or more sponsors (each a "Sponsor") may fund or present the prize.
Champions. People sign up to compete for the prize ("Champions"). Each accepted Champion gets a page and a personal link to share.
Voters. Friends and supporters ("Voters") back a Champion by playing the daily game and, if they choose, by giving to the Cause.
Votes. A Voter earns a Champion one vote for each daily play, at no cost, and one vote for each one dollar ($1.00) given on that Champion's page. A free vote and a given vote count the same on the leaderboard.
The winner. When voting closes, the Champion with the most votes wins the prize. No element of chance decides the winner.
2. Official Rules
Every contest has its own Official Rules, published before Champion sign-up opens. They name the Partner, any Sponsor and the Cause, and set out the contest dates, eligibility, the prize and its approximate retail value, any rounds, how ties are broken, and how the winner is notified. If the Official Rules and these Terms differ on a matter about a contest, the Official Rules control.
3. Who can take part
You must be at least 18 years old and a legal resident of the fifty United States or the District of Columbia, unless the Official Rules state otherwise.
Employees of Thropic, the Partner and any Sponsor, and members of their immediate families and households, may not be Champions or win a prize.
A contest is void where prohibited or restricted by law. We may exclude a state from a contest where the law requires registration, bonding or other conditions that have not been met.
4. Your account
You sign in with a link sent to your email address. Sign-in links are single-use and expire, and anyone who uses your link is signed in as you, so keep it private. You may hold one account. You are responsible for the accuracy of the information you give us. Tell us at info@thropicgames.com if you think someone else has used your account.
5. Champions
Signing up is free. To sign up, you give your name, email address, mobile number, city and state, one photo of yourself and a short profile, confirm you are 18 or older, and agree to these Terms and the Official Rules.
Review. Every sign-up is reviewed before a Champion page goes live. Thropic and the Partner decide, at their sole discretion, who is accepted, and may decline a sign-up without giving a reason. Edits to a Champion page are reviewed again and may be held from public view until approved.
Your own page. A Champion may play daily for their own page. A Champion may not give on their own page, directly or indirectly, and may not use their own money, a business's money or anyone else's money to make gifts on their own page.
Withdrawing. A Champion may withdraw at any time by writing to info@thropicgames.com. When a Champion withdraws or is removed, their votes leave the leaderboard and any gifts made on their page remain with the Cause.
6. Voters and the daily game
Each Voter may play the daily game once per calendar day, in the time zone stated in the Official Rules, for the Champion they back. Each play earns that Champion one vote. No social media login is required. Voters may also give on a Champion's page as described in Section 7. Giving is always optional.
7. Gifts
Gifts go to the Cause. A gift made on a Champion's page is a gift to the Cause named in the Official Rules, not to Thropic, the Partner (unless the Partner is the Cause) or any Sponsor.
Payment. Gifts are processed by Stripe. Each payment is split automatically at the moment it is made: the Cause's share goes directly to the Cause's own account, and Thropic's software fee goes to Thropic in the same transaction. Thropic does not receive, hold or take custody of the Cause's share at any point. Card details are handled by Stripe and are never stored by Thropic.
Receipts and tax. The Cause issues your receipt. Whether a gift is tax-deductible depends on the Cause's tax status and your circumstances. A gift that earns votes may not be fully deductible.
Refunds. Gifts are final. Any refund is at the Cause's discretion under its own policy. Thropic may reverse a gift, and void the votes it earned, in cases of fraud or error.
Thropic's role. Thropic provides technology. Thropic does not solicit gifts for itself and is not a professional fundraiser or commercial co-venturer. Each Partner and Cause is responsible for its own solicitations and its use of funds.
8. Prizes
Prizes are provided by the Partner and any Sponsor named in the Official Rules, which describe each prize and its approximate retail value. Thropic is not the sponsor of any prize unless the Official Rules say so.
Prizes are not transferable and may not be exchanged for cash, except where the prize sponsor substitutes a prize of equal or greater value.
A potential winner must respond within the time stated in the Official Rules and may be required to sign an affidavit of eligibility, a liability release and, where lawful, a publicity release, and to provide a Form W-9 or other tax information. If a potential winner does not respond, is ineligible or declines, the Champion with the next-highest vote total may be selected.
Taxes on a prize are the winner's responsibility. Prizes worth $600 or more in a year are reported to the IRS.
No prize promises the participation of any named athlete, celebrity or event participant unless the Official Rules state it.
Discounts, ticket offers and other offers from a Partner or Sponsor are not prizes and are subject to their own terms.
9. Fair play
Do not:
play by automated means, scripts or bots, or exploit a bug to gain votes;
create or use more than one account, or use another person's email address;
buy, trade or pay for votes from any source other than a gift on a Champion's page;
give on your own Champion page, or arrange for others to give on your behalf with your money;
harass, threaten or impersonate another participant;
interfere with the Platform or its security; or
use the Platform for anything unlawful.
We may void votes, remove a Champion, cancel an account, or withhold or reclaim a prize for a breach of these Terms or the Official Rules. Vote totals as recorded by Thropic's systems are the official record, and decisions made under the Official Rules are final.
10. Your content and publicity
You keep ownership of the photo and words you submit. By submitting them, you give Thropic, the Partner and any Sponsor a limited, non-exclusive, royalty-free right to display your photo, name, profile text, city and state and vote total on your Champion page, on the leaderboard, and in emails, social posts and ads about the contest, for the length of the contest and for the period after it stated in the Official Rules. You confirm that the photo is of you, that you have the right to submit it, and that nothing you submit is false, offensive, or infringes anyone's rights. We may remove content that breaks these Terms without notice.
11. Messages from us
By signing up you agree to receive emails about the contest you joined, including sign-in links, confirmations, standings, reminders and results. If you give your mobile number, you agree to receive text messages about that contest, sent by Thropic on the Partner's behalf. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts, or HELP for help. Consent to texts is not a condition of any gift. You can unsubscribe from non-essential email at any time.
12. Your information
Our Privacy Policy explains what we collect and how it is used and shared, including that the Partner running a contest receives the names, email addresses and locations of the Champions, Voters and givers in that contest. Your information is shared with a Sponsor only if you opt in. Privacy Policy: www.thropicgames.com/privacy-policy.
13. Intellectual property
The Platform, the daily games, and their software, content and design belong to Thropic or its licensors. You may use them only to take part in a contest. The names and marks of each Partner, Sponsor and Cause belong to their owners and are used with permission. No Partner, Sponsor or other organization named in a contest is a party to these Terms unless the Official Rules say so.
14. Changes and availability
We aim to keep the Platform available throughout each contest, but it may be interrupted for maintenance, outages or reasons outside our control. If a contest cannot run as planned because of a technical failure, fraud or a change in the law, the Partner or Thropic may suspend, change or end it as the Official Rules allow, and award the prize based on the votes recorded up to that point. We may update these Terms; the date at the top shows the current version, and continued use after a change means you accept it.
15. Disclaimers
The Platform is provided "as is" and "as available". To the fullest extent the law allows, Thropic disclaims all warranties, express or implied. Thropic is not responsible for lost, late or misdirected entries, votes or gifts; technical failures; errors in posting; the Partner's or Cause's handling of gifts; or the quality, delivery or fulfillment of any prize.
16. Limitation of liability and release
To the fullest extent the law allows, Thropic and its officers, employees and contractors are not liable for indirect, incidental, special or consequential damages arising from the Platform or any contest, and their total liability to you for any claim is limited to one hundred dollars ($100). By taking part, you release Thropic, the Partner and any Sponsor from claims arising from your participation or from accepting or using a prize, except where the law does not allow such a release. Nothing in these Terms limits liability that cannot be limited by law.
17. Indemnity
You agree to indemnify Thropic against third-party claims arising from your breach of these Terms or the Official Rules, or from content you submit.
18. Disputes
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute between you and Thropic will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in a class or representative action. Either party may instead bring an individual claim in small claims court. You may opt out of this arbitration agreement by writing to info@thropicgames.com within 30 days of first accepting these Terms. If arbitration does not apply, any dispute will be resolved individually in the state or federal courts located in Denver, Colorado.
19. General
These Terms, the Official Rules and the Privacy Policy are the whole agreement between you and Thropic about the Platform. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms.
